During this webinar, Tom Crosley will:
• Discuss the basics of UM/UIM claims
• Address the Brainard case and why CPRC Ch. 37 Uniform Declaratory Judgments Act is the proper cause of action for litigating a claimant’s entitlement to UM or UIM benefits
• Discuss the Allstate v. Irwin opinion from the Fourth Court of Appeals
• Discuss the pleading and proof of attorney’s fees at trial, including whether to submit attorney’s fees to the court, or whether to bifurcate the attorneys’ fee issue and present evidence of fees to the jury
